Terms of Service

1. Acceptance

By creating an account or using the Athelm platform ("Service"), you agree to these Terms. If you do not agree, do not use the Service. "DarkHorse Codes", "Athelm", "we", and "us" refer to the operator of athelm.ai.

2. Account Responsibilities

You are responsible for maintaining the security of your account credentials. You must be 18 years or older to create an account. You may not share accounts or credentials. You are responsible for all activity under your account.

3. Acceptable Use

You agree NOT to use the Service to:

  • Generate illegal content, child sexual abuse material, or content that facilitates illegal activity
  • Harass, threaten, or abuse other individuals
  • Attempt to reverse-engineer, extract model weights, or access the AI infrastructure directly
  • Resell or redistribute the Service without explicit written permission
  • Circumvent usage limits or abuse the platform in ways that degrade service for other users
  • Generate spam, phishing content, or deceptive materials at scale

We reserve the right to terminate accounts that violate these terms without refund.

4. Subscription & Billing

Subscriptions are billed monthly. Payment is processed by Stripe. Early pricing tiers (Founding, Early Adopter, Pioneer, Half-Price) are locked at their introductory price for as long as you maintain continuous subscription. Cancellation ends the lock. Resubscription at a locked tier is not guaranteed.

Refunds: We offer a 7-day refund for new subscribers who are unsatisfied. Beyond 7 days, refunds are considered on a case-by-case basis. Contact support@athelm.ai.

5. Intellectual Property

You own all content you create using the Service: avatars, voice clones, generated images, videos, text, and any other outputs. You grant Athelm no license to use your content. The Athelm platform, its UI, codebase, and brand are owned by DarkHorse Codes.

6. Service Availability

We strive for 99.5% uptime but do not provide an SLA for Standard plan subscribers. Premium subscribers receive priority queue access. Planned maintenance will be announced at least 24 hours in advance via status.darkhorse.codes.

7. Limitation of Liability

The Service is provided "as is". We are not liable for: indirect, incidental, or consequential damages; lost profits or revenue; data loss (your data is on your server); service interruptions. Our total liability shall not exceed the amount you paid in the 3 months preceding the claim.

8. AI Output Disclaimer

AI outputs are generated and may contain errors, inaccuracies, or inappropriate content despite safety measures. You are responsible for reviewing all AI-generated content before publishing or acting on it. Do not rely on AI outputs for medical, legal, or financial decisions without professional review.

9. Termination

You may cancel anytime from account settings. We may terminate accounts that violate these Terms, with or without notice. Upon termination, your access ends immediately. Data export is available for 30 days post-termination.

10. Changes to Terms

We may update these Terms with 30 days notice via email. Continued use after notice constitutes acceptance. If you disagree with changes, you may cancel before they take effect.

11. Governing Law

These Terms are governed by the laws of the jurisdiction where DarkHorse Codes operates. Disputes shall be resolved through binding arbitration before resorting to litigation.
